Appeal Update

At the Appeal hearing Friday January 18 2013 morning (Diocese’s appeal against PCSP Town’s “Order to Repair” the Heritage Church), the chair of the Appeal board immediately announced that the Diocesan Synod had delivered to the Town’s lawyer the previous afternoon (i.e. the immediate preceding day) a file (200 pages) of information and case law. The Town’s lawyer had to therefore request a postponement: obviously he has to see and study what is contained in this apparent new information. The postponement was granted: a new date to be set sometime in the future! As far as The Church By The Sea Inc. is concerned, this is another delay tactic by the Diocese. The Diocesan Synod created this appeal 9 months previous (April 2012), the actual appeal date was set more than a month previous, and yet they could only get this file (made by them) to the Town’s lawyer Thursday afternoon before the Friday morning hearing!

 

The Diocesan lawyer said they tried to deliver a copy of the folder to The Church By The Sea Inc. (we are officially listed as an interested party by the Appeal Board): but apparently the Diocesan lawyer couldn’t. Our lawyer at the Appeal hearing had to ask the Appeal Board for a copy: only then did the Diocesan lawyer hand over a copy to us – I guess the Diocese couldn’t find our contact, phone number, mailing address, email or website: even though they had copied sections of our website into their new document.
